Divorce Law in Oregon

In Oregon, a divorcing spouse only has to show that “irreconcilable differences have caused the irremediable breakdown of the marriage.” Simply put, this means that “fault” is not an issue and, generally speaking, the Court will grant a divorce to the spouse who seeks the divorce. However, there are many issues that should be carefully analyzed and considered before a divorce becomes final. A divorce becomes final once it has been reduced to a written judgment of dissolution of marriage. The judgment can be the result of a negotiated settlement between the divorcing spouses. However, if the spouses cannot reach a settlement, the case will be decided by an Oregon judge in a trial. Whether through a negotiated settlement or as a result of a trial, the divorce judgment will generally contain provisions for the following issues.

Family Law Issues

• Custody of the children, including whether custody, which primarily has to do with decision-making, will be “sole” or “joint”
• The amount of time each parent will be able to spend with his or her children, which is commonly known as “parenting time”
• Child support for the children, usually paid by one parent to the other, including child support for a “child attending school,” for children between the ages of 18 and 21 who regularly attend school
• Health insurance for the children
• Spousal support, commonly known as “alimony”
• The division and allocation of assets and debts. Frequently, real estate, retirement accounts and business interests will be divided and distributed
