PracticeDoug has earned a strong reputation in the practice of land use
law and he brings a wealth of experience and knowledge to bear on behalf of his
client’s legal issues. His practice emphasizes matters related to real property,
including land use and other governmental regulations and permits affecting the
use of land. For example; property transactions, leases, easements, boundary disputes,
homeowners association matters, contaminated property, land divisions, zoning,
and foreclosures. He has a proven record representing clients at the local level,
on appeal to the Oregon Land Use Board of Appeals (LUBA) and in the appellate
courts. He also advises clients in the areas of business agreements and disputes,
contracts, estate planning and probate. Representative Work
- Ongoing representation of homeowner and condominium associations on a wide
range of legal issues, including turnover of projects from the developer to the
association and enforcement issues. Represented developers selling and buying
partially developed planned communities.
- Secure land use approvals for
residential subdivisions, commercial development and utilities (electrical substations).
- Assist
clients with projects involving multi-jurisdictional issues, such as cities, counties,
special districts (e.g., ports, road or fire districts), ODOT, DEQ, DSL, EPA and
Army Corps of Engineers.
- Handle rural resource development issues including
aggregate and mining, farm and forest protection, wetlands, and river and coastal
resources.
- Negotiate complex land purchases from willing sellers to conservation
buyers (e.g., Trust for Public Land, METRO and McKenzie River Trust).
- Represent
neighborhood organizations and homeowner associations in opposing unwise development.
For example, secured a decision from the Oregon Court of Appeals protecting the
Jackson-Frazier Wetlands (now a public park) from development and opposed a Wal-Mart
project resulting in construction of a standard store, instead of a super-store.
- Boundary
line adjustments, timber trespass and property disputes.
- Transportation
issues, especially roads and access.
- Hillside development and unstable
or otherwise geologically constrained lands.
- Parks and open space issues.
- Flooding,
drainage and erosion issues.
- Rural home occupation issues (e.g., proposed
towing, pet crematory, bakery and plumbing operations).
- Represent landowners
responding to land use and building code enforcement issues.
- Due diligence
review of hazardous waste issues prior to property purchases and represent owners
on DEQ-required cleanup of hazardous waste.
Background and InterestsDoug
plays baritone sax in a local big band, “Swing Shift”, that plays music by Ellington,
Basie, Brookmeyer, and Olsen. Doug also enjoys running and reading mysteries (not
at the same time, however).
